using the product, replace the product or modify the product to make it noninfringing. IN NO EVENT SHALL SUPPLIER
BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES BASED ON ANY CLAIM OF INFRINGEMENT.
